This Policy explains how we handle your information.
This Privacy Policy describes how Nextoffthetee LLC (d/b/a “NextOff,” “we,” “us,” or “our”), a Florida limited liability company wholly owned and managed by Aurescus Cay Capital LLC, collects, uses, and shares information when you use nextoffthetee.com and our related applications, alerts, and services (together, the “Services”).
By using the Services, you agree to this Policy. If you do not agree, do not use the Services. This Policy is incorporated into our Terms & Conditions.
1. Who We Are & How to Contact Us
The Services are operated by Nextoffthetee LLC, 1215 Algeria Ave, Coral Gables, FL 33134. For any privacy question or request, contact us at support@nextoffthetee.com.
2. Information We Collect
2.0 Notice at Collection — Categories of Personal Information
At or before the point of collection, we provide this notice of the categories of personal information we collect, the business or commercial purpose for each, where it comes from, and who we disclose it to. We collect the following categories:
Identifiers and contact data (name, email address, mobile phone number, IP address, and device identifiers) — collected to create and operate your account, send the alerts you request, communicate with you, and secure the Services. Sources: you, your device, and other users who invite you. Disclosed to: our service providers (e.g., Supabase, Twilio, Resend, Vercel, Railway, and Google).
Account and golf profile data (home course, watched courses, handicap, scores, group size, and saved or completed rounds) — collected to provide the Services and the social “Fourth” features. Sources: you and other users. Disclosed to: our service providers and, only where you choose, other users.
Payment and billing data (the last four digits of your card, card brand, billing ZIP, and subscription status) — collected to process memberships, trials, and renewals. Sources: you and Stripe. Disclosed to: Stripe.
Commercial and transaction data (memberships and purchases, alerts you create, and tee-time searches) — collected to administer your account and memberships. Sources: you and Stripe. Disclosed to: our service providers.
Internet and other usage activity (pages and screens viewed, courses and tee times searched, and interactions with the Services) — collected to operate, secure, and improve the Services. Sources: your use of the Services. Disclosed to: our service providers.
Geolocation data (approximate location from your IP address and, with your permission, precise location) — collected to power map and radius search. Sources: your device. Disclosed to: our service providers.
Audio and communications content (messages you send us, such as support requests, and your preferences) — collected to provide customer support and respond to you. Sources: you. Disclosed to: our service providers.
Inferences (preferences drawn from your activity, such as courses or tee times you may want) — collected to personalize content and remember your preferences. Sources: derived from the data above. Disclosed to: our service providers.
Categories of sources: you, your device, other users, our payment processor, and Google sign-in. Categories of recipients: our service providers/subprocessors (listed in Section 6), other users (only as you choose under Section 5), and legal, safety, or business-transfer recipients (Section 6). NextOff does not sell, and does not “share” (for cross-context behavioral advertising), any category of personal information.
2.1 Information you provide to us
Account information: your name, email address, and (if you enable text alerts) your mobile phone number.
Authentication: we offer passwordless “magic link” email sign-in and Google sign-in (OAuth). If you sign in with Google, we receive basic profile information (such as your name and email) as permitted by your Google settings.
Profile and golf data: your home course, courses you watch, handicap, scores you log, group size, saved or completed rounds, and any other details you choose to add.
Payment information: if you purchase a membership, payment is processed by Stripe. We do not store full card numbers; we receive limited billing details (such as the last four digits, card brand, and billing ZIP) and your subscription status.
Communications: messages you send us (for example, support requests) and your preferences.
2.2 Information we collect automatically
Device and connection data: IP address, browser type, operating system, device identifiers, and similar technical data.
Usage data: pages and screens viewed, courses and tee times searched, alerts created, and interactions with the Services.
Location data: approximate location derived from your IP address and, with your permission, more precise location to power map and radius search.
Cookies and similar technologies: see Section 8.
2.3 Information from third parties
Google, when you choose Google sign-in, as described above.
Other users: if someone invites you to a round or adds you as a friend, we may receive your name or contact information from them.
We also display tee-time, course, pricing, and availability information sourced from golf courses and third-party booking platforms. That course data is generally not your personal information; how we handle the Services’ data is addressed in our Terms & Conditions.
2.4 Sensitive Personal Information
Under the CPRA, two limited categories of the information above are treated as “sensitive personal information” (SPI): your precise geolocation (collected only when you grant your device’s location permission) and your account log-in credentials (used for our magic-link and Google sign-in). We use and disclose SPI only for the purposes described in this Policy — to power map and radius search and to authenticate you — and we do not use or disclose SPI to infer characteristics about you. Because we do not use SPI for any purpose that gives rise to the right to limit its use, we are not required to offer a “Limit the Use of My Sensitive Personal Information” link.
3. How We Use Your Information
Provide, operate, and improve the Services, including search, booking hand-off, and the social “Fourth” features.
Send you the tee-time alerts you request, by text message and/or email (see Section 4).
Create and manage your account, process payments, and administer memberships, trials, and renewals.
Communicate with you about your account, transactions, security, and changes to the Services or our policies.
Send you product news, offers, and marketing (you can opt out at any time — see Sections 4 and 7).
Personalize content, remember your preferences, and provide customer support.
Maintain the security and integrity of the Services, prevent fraud and abuse, and enforce our Terms.
Comply with law and protect our legal rights.
4. Text Messages & Email Communications
4.1 SMS / text alerts (TCPA)
A core feature of the Services is real-time tee-time alerts. If you provide your mobile number and opt in, you give your prior express written consent to receive recurring automated text messages from NextOff at that number, including alerts and account or marketing messages. Consent is not a condition of purchasing any goods or services. Message frequency varies based on the alerts you set. Message and data rates may apply.
Reply STOP to any message to cancel; reply HELP for help.
You may also manage or disable alerts in your account settings.
Our messaging program is registered for application-to-person (A2P 10DLC) messaging. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed.
4.2 Email
We send transactional email (for example, alerts, receipts, and account notices) via Resend. You can unsubscribe from marketing email using the link in those messages; we will still send you non-marketing, transactional messages about your account.
5. Public Profiles & Social Features
Please read this section carefully. The Services include social features to help you build a foursome (“the Fourth”), including a friend graph, invitations, request-to-join rounds, and profiles.
Profiles are discoverable by default. By default, your profile (such as your name) can be found by other users through search so they can connect with you. You can turn off discoverability at any time — use the one-time prompt shown when you first sign in, or the discoverability toggle in your profile settings. Turning it off removes your profile from user search.
Information you choose to share — such as friends and rounds — may be visible to users you connect or play with. Your sensitive golf data, including your scores and handicap, is not shown to other users unless you affirmatively choose to share it.
Do not post anything you would not want other users to see. Information shared with other users is outside our control once shared.
6. How We Share Information
Do Not Sell or Share. We do not sell your personal information, and we do not “share” it for cross-context behavioral advertising, as those terms are defined under U.S. state privacy laws. We have not sold or shared personal information in the preceding 12 months. We share information only as described below.
Service providers (subprocessors). We share information with vendors who process it on our behalf under contract, including: Stripe (payments), Twilio (text messaging), Resend (email), Supabase (database, authentication, and storage), Vercel and Railway (hosting and infrastructure), and Google (sign-in).
Other users: as described in Section 5, when you use the social features.
Legal and safety: when we believe disclosure is required by law or legal process, or necessary to protect the rights, property, or safety of NextOff, our users, or others.
Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
With your direction or consent, or in aggregated or de-identified form that cannot reasonably identify you.
7. Your Privacy Rights & Choices
Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of certain processing. We honor verifiable requests under applicable U.S. state privacy laws, including the California Consumer Privacy Act (as amended by the CPRA), and the comparable laws of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana.
You have the following rights, subject to verification and the limits of applicable law:
Know / access. Request the categories and specific pieces of personal information we have collected about you and how we use and disclose it.
Correct. Request that we correct inaccurate personal information we hold about you.
Delete. Request that we delete personal information we collected from you.
Portability / copy. Obtain a copy of your personal information in a portable, machine-readable format.
Opt out of sale or sharing. Direct us not to sell or “share” your personal information. NextOff does not sell or share personal information, so there is nothing to opt out of.
Opt out of targeted advertising. Direct us not to process your personal information for targeted advertising. We do not engage in targeted advertising.
Opt out of profiling. Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not conduct such profiling.
Limit use of sensitive personal information. Direct us to limit our use of SPI to permitted purposes. As explained in Section 2.4, we already limit SPI to the purposes disclosed in this Policy.
How to submit a request. To exercise any right, email support@nextoffthetee.com. Because NextOff operates exclusively online, this email address is our designated method for submitting requests and satisfies the CCPA’s requirement to provide consumer request methods. We may need to verify your identity before acting and will not fulfill a request we cannot reasonably verify.
Authorized agents. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may require you to verify your own identity directly with us.
Response timeline. We will respond to a verifiable request within 45 days. When reasonably necessary, we may extend this period by an additional 45 days and will notify you of the extension and the reason.
Right to appeal. If we decline to act on your request, you may appeal by emailing support@nextoffthetee.com with the subject line “Privacy Appeal.” We will respond in writing within the time your state’s law requires, and if we deny your appeal you may contact your state attorney general. This appeal right applies to residents of Virginia, Colorado, Connecticut, Texas, Oregon, and Montana; California provides a different complaint process.
We will not discriminate against you for exercising your rights.
California “shine the light” / sale-share: we do not sell or share personal information as those terms are defined under California law.
Marketing choices: opt out of marketing email via the unsubscribe link; opt out of text messages by replying STOP; control cookies as described in Section 8.
The Services are intended for users in the United States. We do not offer the Services to, or knowingly process the personal information of, individuals located in the European Union or United Kingdom.
8. Cookies & Tracking Technologies
We and our service providers use cookies and similar technologies to keep you signed in, remember your preferences, and operate the Services. We use only essential and functional cookies; we do not use cookies for third-party advertising. You can control cookies through your browser settings, though some features may not work without them.
9. Data Retention
We keep personal information only for as long as needed for the purposes described in this Policy. Because retention periods vary by the type of information and why we hold it, we use the following criteria to determine how long to keep each category:
Account, authentication, and golf profile data: kept while your account is active and deleted within a reasonable period after you delete your account, except as needed for the purposes below.
Payment and billing records: retained for the period required by tax, accounting, and financial-reporting laws (generally up to seven years).
Commercial and transaction data: retained for the life of your account and as needed to administer memberships, trials, and renewals.
Communications and support records: retained as long as needed to resolve your matter and for a reasonable period afterward.
Device, usage, and approximate-location data: retained for a limited period to operate, secure, and improve the Services.
Precise geolocation: retained only as long as needed to provide map and radius search for your session.
After these periods, we delete or de-identify the information, or retain it only as necessary to comply with law, resolve disputes, and enforce our agreements. We may retain aggregated or de-identified data indefinitely.
10. Data Security
We use reasonable administrative, technical, and physical safeguards, including encryption in transit and access controls, and rely on PCI-compliant processing for payments. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Children’s Privacy
The Services are intended for adults and are not directed to anyone under 18, and we do not knowingly collect personal information from anyone under that age. Consistent with the Children’s Online Privacy Protection Act (COPPA), we also do not knowingly collect personal information from children under 13. If you believe a minor has provided us information, contact support@nextoffthetee.com and we will delete it.
12. Third-Party Links & Services
The Services link out to third-party sites — including golf course and booking sites where you complete a reservation. We are not responsible for the privacy practices of those third parties; review their policies.
13. Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new effective date and, where required, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Policy.
